(Lexicon) provides the Lexicon services (defined below) to you subject to the following Terms of Service (TOS), which may be updated by us from time to time without notice to you. In addition, when using particular Lexicon owned or operated services, you and Lexicon shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules (including but not limited to our spam policy) are hereby incorporated by reference into the TOS.
Using Our Website and Your Registration Obligations
As a user on any Lexicon website, you have the ability to share your voice by posting your own content. You are also solely responsible for the content you post. In consideration of your use of the Lexicon services, you represent that you are of legal age to form a binding contract and are not a person barred from receiving the Lexicon services under the laws of the United States or other applicable jurisdiction. If you provide any information that is untrue, inaccurate, not current or incomplete, or Lexicon has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Lexicon has the right to suspend or terminate your account and refuse any and all current or future use of the Lexicon services (or any portion thereof). You must be aged 13 or over to use the services. Children under the age of 13 are held responsible for their use or the service by their parent or guardian and it is the ongoing responsibility of the parent or guardian to determine whether any of the Lexicon services and/or content is appropriate for the child. Please make sure you have the necessary rights for any images or music before you post them. Rights must take the form of licenses or copyrights issued to the person registered to the account where the content is posted.
Please treat the lexicon.org website like it’s your own. As stated in the registration obligations, it is not permissible to post or encourage anyone else to post false, unlawful, threatening or otherwise harmful content or to post any content that infringes upon any copyright or other proprietary rights.
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (content), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated. This means that you, and not Lexicon, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via the Lexicon services.
Lexicon does not control the content posted via the Lexicon services and, as such, does not guarantee the accuracy, integrity or quality of such content. You understand that by using the Lexicon services, you may be exposed to content that is offensive, indecent or objectionable. We will do our best to make sure this does not occur. However, under no circumstances will Lexicon be liable in any way for content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the Lexicon services.
It is illegal to send spam or send harassment of any kind while utilizing the Lexicon services or to other users who are using the services. We will work hard to keep this public forum a safe space. You can help us by sending a note to email@example.com if you observe any unpleasant activity on the site. We reserve the right to remove or refuse to post any content that violates these Terms, or that is otherwise objectionable.
Be aware that we do not review user content before it is posted, nor do we necessarily agree with the views expressed by our users. We can’t guarantee the accuracy, integrity or quality of user content. Lexicon of Food is not liable for any user content under any circumstances or for any loss or damage, or any claims to rights that occur as a result of user content. User-generated content includes anything a user transmits, uploads, or posts, including data, text, music, sound, photographs, graphics, images, videos, messages or other materials.
If a user posts something we like, we may want to utilize it. When you post content, you are agreeing to let us copy, edit, display and distribute it as we see fit. We unfortunately cannot compensate you for your content, and don’t have control over content once it leaves our web properties. In accordance with our TOS you agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion or use of, or access to, the Lexicon services (this includes content, advertising, software, data and your Lexicon profile).
You agree to indemnify and hold Lexicon and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit, modify or otherwise make available through the Lexicon services, your use of the Lexicon services, your connection to the Lexicon services, your violation of the TOS, or your violation of any rights of another.
If you’d like to terminate your account, you may do so on this website, Lexicon of Food, under your profile. You’ll receive a confirmation email once your cancellation is processed.
You agree that Lexicon may, without prior notice, immediately terminate, limit your access to or suspend your Lexicon account, any associated email addresses and access to the Lexicon services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, © discontinuance or material modification to the Lexicon services, (d) unexpected technical or security issues or problems, (e)extended periods of inactivity, (f) engagement by you in fraudulent or illegal activities, and/or (g) nonpayment of any fees owed by you in connection with any Lexicon services. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in Lexicon’s sole discretion and that Lexicon shall not be liable to you or any third party for any termination of your account, or access to the Lexicon services.
